PRESS RELEASE
On March 6 and 10, 1998 I spoke on the Floor of the House in opposition to House
Bill 2568 HD1 which restructures Hawaii's tax system by implementing some of the
most highly controversial recommendations of the Governor's Economic Revitalization
Task Force. I support that part of the bill which decreases the income tax burden
on Hawaii's taxpayers but strongly oppose any increase in the General Excise Tax.

TRANSPORTATION
SEATBELTS
HB 2358HD2 Requires first time violators who fail to implement the child passenger
restraint law to attend child passenger safety class. Lowers the fine for second
conviction from $300 to $200, but also removes the 1-year limit for qualification
as repeat offenses.
MOPED SAFETY
HB 2897 Standardizes the definition of a moped's horsepower and maximum speed
restrictions, provided that mopeds registered prior to the effective date of this
Act remain subject to the prior thirty-five miles per hour maximum speed limitation.
HB 3581 Proposes to penalize people who operate mopeds on a roadway without a
license by making them subject to a maximum fine of $1000 or imprisonment not more
than 30 days or both.
GENERAL TRAFFIC SAFETY
HB 2332 Requires the removal or immediate reporting of items falling from motor
vehicles onto highways or roadways.
DUI RELATED
HB 3082 Requires that a person charged with habitual DUI offenses is subject to
Administrative Revocation of the person's license. Instead of being able to drive
while awaiting trial, the person's license can be revoked immediately.
HB 3185 Permits the administrative revocation of the driver's license of a person tested for
evidence of driving under the influence of intoxicating liquor after having been
involved in a motor vehicle accident, and the test results indicates probable
cause.
PORTS
HB 2998HD2 Creates a temporary Maritime authority commission which will propose
the exact form and details for the establishment of the Hawaii Maritime Authority
to the legislature for action in the regular session of 1999.
HB 3489HD2 Sets fees for cruise boats possessing a valid mooring permit or having
a Kewalo Basin sublease.

AIRPORT/TOURISM
HB 2376HD1 Requires the Department of Transportation, in cooperation with the
Department of Business, Economic Development, and Tourism (DBEDT) and the state procurement
office, to authorize the implementation of a people mover system using private sector
funds.
HB 2345HD2 Extends the criminal and civil penalty provisions for the State motor
carrier law to shippers and consignees in the State who contract and utilize the
services of illegal motor carriers.
HB 2346HD2 Requires an applicant for a commercial driver's license for transporting hazardous materials, in addition to completing certain forms and certifications, to take and pass a knowledge test, but does not require knowledge tests of other applications
for a commercial driver's license.
HB 3183HD2 Reduces the temporary service period of a common carrier or a contract
carrier to 90 days. Provides that a hearing on an application for a certificate of
public convenience and necessity, or for a permit seeking corresponding permanent
authority, is held not later than the last day of the expiration date of the granting
of temporary authority.
EDUCATION
HB 2518 Converts the Hilo Community School for Adults, positions of Principal
and School Administrative Service Assistants to permanent positions.
HD 2541HD1 Authorizes the Department of Education to establish a comprehensive student support system (CSSS) as a pilot project in 7 school complexes on the islands of Kauai, Oahu, Molokai, and Hawaii to create a school environment in which every
student is cared for and respected.
HB 2563 Amends chapter 37, HRS, to facilitate implementation of school-based budgeting.
HB 2564HD1 Stipulating the department of education (DOE) to require that: (1) Beginning with
the school year 2000/2001, all pupils completing the eighth grade be computer
literate as defined by the board; and (2) Beginning with the 2004-2005 school year,
all pupils graduating from high school be competent in at least one language, other
than English. Requires DOE to develop an implementation plan and to submit the plan
to the legislature prior to the 1999 regular session.

HB 2565HD1 Requires the Board of Education to consult with the union representing Unit 6
(educational officers) to allow the Department of Education more flexibility in
assigning Principals and Vice-Principals.
HB 2680HD2 Improves the management of student-centered schools.
HB 2685HD2 Establishes a school-to-work opportunities trust fund.
HB 2736HD2 Requires funding for coaches' salaries, athletic health care specialists, athletic
equipment and supplies, and the transportation of athletic teams to be considered
standard workload increase items when planning and budgeting for new public
schools.
HB 2834HD1 Transfers, from PSD to DOE, security function at DOE and public library system
facilities effective 7/1/98.
HB 2835HD1 Permits DOE to rehire retired teachers through school year 2000-2001 instead of
only through the 1997-1998 school year, but reduces salary from 100% to 70% of
full time equivalents.
HB 3164HD3 Transfers peer education program from DOH to DOE.
HB 3207HD1 Converts 40 temporary athletic health care trainer positions to permanent
status.
HB 3452HD2 Permits the Department of Education to set the price of school lunches
up to one hundred per cent of the non-federal cost of preparing the school lunch.
HB 3616HD1 Permits the Department of Education to employ retired police officers, who will retain their normal retirement benefits, in school security positions.
REPRESENTATIVE MOSES'S TESTIMONY ON CLOSING A BEACH ACCESS ROAD AT
BARBERS POINT
Attached for your information is my testimony in opposition to HB 2787 HD1. This
bill is another step toward a State run airport at Barbers Point. The State DOT would
close an access road on Barbers Point, as demanded by the FAA. Through years of public
hearings, the people of the region were assured that this access road to the shoreline
would never be limited. The People of Hawaii are opposed to limiting access to the
lands they call home.
Public Hearing by the Department of Land Utilization
A request for a variance of the Land Use Ordinance will be held tomorrow, Thursday,
March 19, 1998 at 1:30 PM in the Personnel Conference Room, City Hall Annex. The
applicant is Chevron Products Company at 91-250 Hanua Street and 91-480 Malakole
Street, Campbell Industrial Park. The variance is to allow crude oil and naphtha
storage tanks to exceed the height limit.

Corrective Action Plan for Subsurface Plume at Chevron Kapolei Refinery
The Environmental Protection Agency and the Hawaii Department of Health will hold
a public hearing if substantial public interest exists or a request for a public
hearing is received. To review plans for this project call Ms. Vicki Tsuhako of the
Honolulu EPA's office at 541-2710. All comments must be postmark by MARCH 16, 1998
and should be addressed to Mr. Paul Kalaiwaa, Hawaii Department of Health, Solid
and Hazardous Waste Branch, 919 Ala Moana Blvd., Room 212, Honolulu, HI 96820.
REPRESENTATIVE'S REQUEST FOR HIGH SCHOOL FUNDING
I have written to Representative Calvin Say, the Chairman of the House Finance Committee on the critical need for the Kapolei High School. I pointed out to him the need to meet construction deadlines. (Letter attached.)
